These Terms of Service ("Terms") govern your use of the POURED mobile application (the "App"), operated by Poured Concierge LLC ("POURED," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Who Can Use POURED

POURED is intended for adults of legal drinking age in their jurisdiction (21 and older in the United States). By using the App, you confirm that you meet this requirement. POURED does not sell alcohol and does not facilitate the purchase of alcohol.

What POURED Does

POURED is an AI-powered beverage concierge. It provides information, suggestions, and guidance about wine, beer, and spirits through expert personas (Luc, Hank, and Monica), including the ability to analyze beverage labels you photograph and answer questions you ask. POURED also builds a personalized taste profile to tailor its recommendations.

Informational Purpose and No Guarantees

The content POURED provides is generated in part by artificial intelligence and is offered for general informational and entertainment purposes only. Recommendations, descriptions, and analyses may be incomplete or inaccurate. POURED does not provide medical, dietary, or professional advice. You are responsible for your own choices, including the responsible and lawful consumption of alcohol. Please drink responsibly and never drink and drive.

Your Account

To use certain features, you must create an account using Sign in with Apple or email-based sign-in. You are responsible for keeping your account credentials secure and for activity that occurs under your account. Notify us at hello@pouredconcierge.com if you believe your account has been compromised.

Subscriptions and Payments

POURED offers a free tier and paid subscription tiers. Paid subscriptions are billed through your Apple App Store account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple App Store account settings. Refunds, where applicable, are handled by Apple in accordance with Apple's policies. Pricing and tier features may change; we will provide notice of material changes as required.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose

  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the App or its systems

  • Submit content that is unlawful, infringing, or harmful

  • Use the App on behalf of anyone under the legal drinking age

Content You Submit

When you submit photos or questions, you grant us the right to process that content to provide the App's features, including sending it to third-party AI services for analysis. You are responsible for ensuring you have the right to submit any content you provide.

Intellectual Property

The App, including its design, expert personas, and content we create, is owned by Poured Concierge LLC and protected by applicable laws. You may not copy, distribute, or create derivative works from the App without our permission.

Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that its content will be accurate.

Limitation of Liability

To the fullest extent permitted by law, Poured Concierge LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the App.

Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or for any other reason. You may stop using the App at any time and may request account deletion by contacting us.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles.
